1. Scope and Provider

These Terms of Service ("Terms") govern your use of the Prezly mobile application and associated services ("Service"), operated by:

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Description of Service

Prezly is an AI-powered gift curation app that helps users discover, save, and organize gift ideas for their partners. The Service includes:

  • Partner profile management
  • Product and gift idea archiving
  • AI-powered gift suggestions
  • Gift boxes, advent calendars, and occasion planning
  • Share-a-hint functionality
  • Experience and wishlist features

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account

You must be at least 16 years old to create an account.

4. Free and Premium Plans

The Service offers a free tier with limited features and a Premium subscription with extended functionality.

  • Free tier: Includes basic features with a limited number of AI suggestions per month
  • Premium: Unlocks unlimited AI suggestions and all premium features

Premium subscriptions are billed through the Apple App Store or Google Play Store. Pricing, billing cycles, and cancellation terms are governed by the respective store's terms. You can manage or cancel your subscription at any time through your device's subscription settings.

5. Acceptable Use

You agree to use the Service only for its intended purpose. You may not:

  • Use the Service for any unlawful purpose
  • Submit content that is harmful, offensive, or violates third-party rights
  • Attempt to reverse engineer, modify, or interfere with the Service
  • Use automated tools to access or scrape the Service
  • Circumvent usage limits or access controls

We reserve the right to suspend or terminate accounts that violate these terms.

6. User Content

You retain ownership of all content you submit to the Service (product names, photos, notes, etc.). By using the Service, you grant us a limited license to store and process your content solely for providing and improving the Service.

We do not share your content with third parties for advertising purposes. AI-powered features may process your content to generate suggestions, but this data is not used to train external AI models.

7. AI Features

The Service includes AI-powered features (gift suggestions, pattern insights) provided via third-party AI services. These features:

  • Are provided "as is" without guarantees of accuracy
  • May generate suggestions that are not suitable or available for purchase
  • Are subject to usage limits on the free tier

We are not responsible for purchasing decisions based on AI suggestions.

8. Intellectual Property

The Service, its design, code, and branding are the intellectual property of Prezly. You may not copy, modify, distribute, or create derivative works of the Service without prior written consent.

9. Limitation of Liability

To the extent permitted by Swiss law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages arising from the use of the Service
  • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim
  • We are not responsible for the availability, accuracy, or quality of third-party products suggested through the Service

10. Account Deletion

You can delete your account at any time from within the app (Settings > Delete Account). Upon deletion:

  • All personal data is permanently removed from our systems
  • Active subscriptions must be cancelled separately through the App Store or Google Play Store
  • Deletion is irreversible

11. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated through the app or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Applicable Law and Jurisdiction

These Terms are governed by Swiss law. Any disputes arising from or related to these Terms or the Service are subject to the exclusive jurisdiction of the competent courts in Switzerland.
